The Administrative Appeals Tribunal considered an application for a Temporary Skill Shortage (Class GK) visa, Subclass 482, medium-term stream. The applicant sought review of a decision concerning the approval of a nomination for the occupation of Computer Network and Systems Engineer. The Tribunal, constituted by Terrence Baxter, was tasked with determining whether the nomination had been approved in accordance with the relevant legislative provisions.

The central legal issue before the Tribunal was whether the nomination, as identified in the visa application, had been approved under section 140GB of the Migration Act 1958 (Cth) and whether the nominator was an approved work sponsor at the time of approval, a requirement stipulated by clause 482.212(1) of Schedule 2 to the Migration Regulations 1994 (Cth). The Department of Home Affairs had initially refused the nomination application, but the sponsor subsequently sought review of this decision.

The Tribunal found that the requirements of clause 482.212(1)(a) were met. This was because, on 23 October 2023, the Tribunal had set aside the Department's refusal decision and substituted a decision to approve the nomination. Having determined that the nomination criteria were satisfied, the Tribunal concluded that the appropriate course of action was to remit the matter to the Minister for reconsideration of the remaining visa criteria.
