CaseChat Overview and Summary
The Administrative Appeals Tribunal reviewed a decision concerning a nomination for a visa under the Direct Entry stream. The applicant, OM Mahalaxmii Foods Pty Ltd, sought approval of a nomination for a Retail Manager position. The core dispute revolved around whether the nominator met the various legislative requirements for approving such a nomination, particularly those pertaining to the genuineness of the position and the nominator's operational status.
The Tribunal was required to determine if OM Mahalaxmii Foods Pty Ltd was actively and lawfully operating a business in Australia, if there was a genuine need for the nominated employee, and if the terms and conditions of employment offered were not less favourable than those provided to Australian citizens or permanent residents in equivalent roles. Additionally, the Tribunal had to consider whether there was any adverse information known to Immigration concerning the nominator or associated persons, and if the nominated tasks corresponded to the requirements of the specified occupation under the relevant legislative instruments.
In reaching its decision, the Tribunal examined evidence demonstrating that OM Mahalaxmii Foods Pty Ltd was registered with ASIC, held multiple licenses for operating Carl's Jr stores, and was actively expanding its operations with several stores already trading. The Tribunal was satisfied that the nominated position of Retail Manager aligned with the tasks prescribed in ANZSCO Code 142111 and that the nominee was offered employment on terms and conditions that met the legislative standard. Crucially, while a director of a related business had previously been subject to a sponsorship bar, this bar had expired and related to a different ABN, leading the Tribunal to conclude there was no adverse information relevant to the current nominator that warranted disregarding the nomination.
Consequently, the Tribunal set aside the original decision and substituted a decision approving the nomination.
