CaseChat Overview and Summary
The court had to determine if the enterprise agreement complied with the procedural and substantive requirements of the Fair Work Act. This involved assessing whether the agreement was made in good faith, covered the necessary minimum terms, and did not discriminate against employees. The court also considered whether the agreement provided for a proper process for its negotiation and if it was supported by a majority of the relevant employees.
In reaching its decision, the court examined the evidence presented by the applicants regarding the negotiation process and the support from the majority of the employees. The court found that the agreement was negotiated in good faith and covered all the required minimum terms. The court also determined that the agreement did not contain any discriminatory provisions and was supported by a majority of the relevant employees. Consequently, the court approved the Lowes Bulk Fuel Drivers (Victoria) Enterprise Agreement 2022.
The final orders of the court were that the Lowes Bulk Fuel Drivers (Victoria) Enterprise Agreement 2022 be approved and registered with the Fair Work Commission. The agreement was to take effect from the date of the decision and would govern the employment terms and conditions for bulk fuel drivers in Victoria under the approved enterprise agreement.
