Ocean Spray Cranberries, Inc. (Ocean Spray) brought proceedings against Sunraysia Natural Beverage Company Pty Ltd (Sunraysia) concerning the use of the word "cranberry" in relation to Sunraysia's products. Ocean Spray, a well-known producer of cranberry-based beverages and food products, alleged that Sunraysia's use of "cranberry" on its packaging and in its marketing was misleading and deceptive, in contravention of Australian Consumer Law. The dispute centred on whether Sunraysia's products, which contained only a small percentage of cranberry juice, could legitimately be described as "cranberry" beverages.

The primary legal issue before the court was whether Sunraysia's conduct in marketing its beverages as "cranberry" constituted misleading or deceptive conduct under section 18 of the Australian Consumer Law. This required the court to consider the ordinary meaning of the word "cranberry" in the context of beverage marketing and whether consumers would be likely to be misled into believing that the products contained a significant or predominant proportion of cranberry juice, when in fact they did not.

Justice Forno found that the use of the word "cranberry" by Sunraysia was likely to mislead or deceive consumers. The court reasoned that in the context of beverage marketing, the prominent use of a fruit name typically signifies that the fruit is a primary or significant ingredient. Given that Sunraysia's products contained a very low percentage of cranberry juice, often alongside other fruit juices, the court concluded that the description was not a fair representation of the product's composition and would likely lead consumers to form an erroneous belief about its contents.

The court ordered that Sunraysia be restrained from using the word "cranberry" in a manner that was misleading or deceptive, and that it pay Ocean Spray's costs.
