The dispute before the District Court of New South Wales concerned an application for spouse maintenance. The applicant, O'Shannessy, sought maintenance from the respondent, Foster.

The primary legal issue before the court was whether the applicant was entitled to spouse maintenance and, if so, the appropriate quantum of that maintenance.

His Honour Faulks DCJ ordered that the respondent pay spouse maintenance to the applicant in the sum of $1,384 per week, commencing from the date of the order, and continuing until further order of the court.
