Finally, the Court held that it was not open to the jury to find the appellant guilty on the basis of the second pathway, as the jury's failure to agree upon a verdict in respect of the co-accused meant that the jury could not have convicted the appellant on that basis. The appeal is therefore unmeritorious, and the Court dismissed the appellant's application for an extension of time within which to appeal and refused leave to appeal.
