CaseChat Overview and Summary

The matter before the Fair Work Commission involved an application for the approval of the Neway Transport WestAus Certified Agreement 2017. The applicant, NT WestAus Pty Ltd trading as Neway Transport, sought approval of the agreement, which was to be applied to employees classified as "General Employee" under the agreement. The primary dispute centred around the terms and conditions of employment as stipulated in the agreement, including wages, hours of work, and other employment-related matters.

The legal issues before the court were whether the agreement provided for the protection of employees' rights, whether it was made in accordance with the relevant industrial legislation, and whether it met the criteria for approval under the Fair Work Act 2009. Specifically, the court had to determine if the agreement complied with the procedural requirements, if it contained provisions that were contrary to public policy or the general law, and if it was fair and reasonable in all its terms. The court also needed to assess if the agreement was made without any improper influence or coercion.

In determining the application, the court considered the process through which the agreement was negotiated and the extent to which it provided for fair and reasonable terms for the employees. The court examined the submissions made by the parties and the evidence provided, focusing on the procedural fairness of the agreement-making process and the substantive fairness of the terms. The court found that the agreement was negotiated in good faith, was not made under duress, and contained terms that were fair and reasonable. The court concluded that the agreement met all the necessary criteria for approval and did not contravene any public policy or general law principles. Consequently, the court approved the Neway Transport WestAus Certified Agreement 2017.
