Consequently, the lease was void for uncertainty, as it was impossible to ascertain with the requisite degree of certainty the land over which exclusive possession was purportedly granted. The Court applied the principle that for a grant of an interest in land to be valid, the subject matter of the grant must be clearly and precisely defined.

The appeal was dismissed, and the judgment of the Supreme Court of Queensland was affirmed.
