Given the lack of agreement on an alternative lender and the husband's failure to comply with previous orders, the court concluded that the parties were obliged to revert to their original consent orders, which required them to apply to Macquarie Bank for the necessary funds and subsequently address the refinancing of the Macquarie Bank facility due in April 2007.
