CaseChat Overview and Summary

This matter concerned an application by Ms Noonan (the Applicant Mother) against Mr Reardon (the Respondent Father) in the Family Court of Australia. The dispute arose from the Father taking the subject child, S, born October 2011, from the Mother by force. The Father had allegedly promised to return the child but failed to do so. The Mother sought urgent orders on an ex parte basis, citing a substantial history of domestic violence.

The court was required to determine whether to grant the application on an ex parte basis, meaning without notice to the Father, and to consider the issuance of a recovery order for the child. Additionally, the court considered whether to grant interim orders for the Mother to have sole parental responsibility for the child and for the child to live with her. The court also had to decide on the terms of any recovery order, including authorisations for law enforcement, and whether to prohibit the Father from further taking possession of the child.

Justice Kent applied Rule 5.12 of the Family Law Rules 2004 (Cth), which permits applications to be made without notice in certain circumstances. His Honour was satisfied, based on the material before the court, including the Mother's affidavit and oral submissions, that there was a significant history of family violence. Consequently, the court found it expedient to make orders without notice to the Father, rather than simply abridging the time for service and fixing an early hearing. The court reasoned that this approach was more appropriate given the circumstances, and that the Father would have an opportunity to respond at a future interim hearing.

The court granted leave for the Initiating Application to proceed on an ex parte basis and abridged the time for service. A recovery order was issued pursuant to s 67Q of the Family Law Act 1975 (Cth), authorising law enforcement officers to find and recover the child and deliver her to the Applicant Mother. The Father was prohibited from again removing or taking possession of the child unless in accordance with court orders. The Mother was granted sole parental responsibility for major long-term issues concerning the child, and the child was ordered to live with the Mother. The application was adjourned for the fixing of a further interim hearing date, with liberty to apply.
