Nolan and Klein (No 2)

In *Nolan and Klein (No 2)*, Strickland J of the Family Court of Australia considered an application for final orders concerning the living arrangements and parental responsibility for two children, P and E. The dispute arose between the children's mother and father.

The central legal issue before the court was to determine the final parenting orders for the children, specifically whether they should live with the mother or the father, and who should hold sole parental responsibility. The court was also required to consider the implications of any contravention of the orders made.

Strickland J dismissed the mother's application for final orders. The court ordered that the children, P and E, live with the father and that the father have sole parental responsibility for them. The order appointing an Independent Children’s Lawyer was discharged. The court also directed that a Fact Sheet detailing the obligations created by the orders and the consequences of contravention, pursuant to sections 62B and 65DA(2) of the *Family Law Act 1975*, be attached to the orders.
