The Full Federal Court considered an appeal concerning the interpretation of a settlement agreement. The parties, NJG and KSPG, had entered into this agreement to resolve a dispute regarding intellectual property rights. The core of the disagreement revolved around whether KSPG had breached the terms of the settlement by continuing to use certain intellectual property after the agreement had been executed.

The court found that the terms of the settlement agreement, when properly construed, did not grant KSPG the unfettered right to use the intellectual property in the manner they had. Consequently, the court held that KSPG had breached the settlement agreement.
