NHAN & TANG

In the matter of NHAN & TANG, heard before Judge Scarlett, the dispute concerned parenting orders for a child, X, born in 2010. The proceedings involved an application for final orders, with certain existing consent orders from 28 July 2014 being subject to suspension.

The court was required to determine the living arrangements for the child X, and whether the child should be permitted to travel internationally. This involved considering the welfare of the child and the relevant provisions of the *Family Law Act 1975* and the *Australian Passports Act 2005*.

Judge Scarlett made orders suspending previous consent orders. The child X was to live with the Applicant father. Furthermore, the Applicant father and the child's paternal grandparents, MS K and MR N, were permitted to take the child out of Australia, in accordance with section 65Y of the *Family Law Act 1975*. The child was also permitted to travel internationally as provided by section 11 of the *Australian Passports Act 2005*, and the father was to hold the child's passport. The Application for Final Orders was adjourned for mention.
