The Administrative Appeals Tribunal considered an application for a Partner (Temporary) (Class UK) visa, Subclass 820 (Partner), made by an applicant claiming to be the spouse of an Australian citizen. The central dispute was whether the applicant and the sponsor were in a genuine and continuing married relationship as defined by the Migration Act 1994 (Cth) and the Migration Regulations 1994 (Cth).

The Tribunal was required to determine if the parties met the criteria for a spouse relationship under section 5F of the Act. This involved assessing whether they were validly married, had a mutual commitment to a shared life to the exclusion of all others, and whether their relationship was genuine and continuing, living together or not permanently separated. The Tribunal also had to consider all circumstances of the relationship, including financial, household, social aspects, and the nature of their commitment, as outlined in regulation 1.15A(3).

The Tribunal accepted the validity of the marriage certificate presented, confirming the parties were married under Australian law. However, it found that this evidence alone was insufficient to demonstrate a mutual commitment to a shared life or a genuine and continuing relationship. The Tribunal considered oral and documentary evidence, including statements from the applicant, sponsor, and witnesses, as well as the contents of departmental and tribunal files, to assess the various aspects of the relationship.

Ultimately, the Tribunal remitted the application for reconsideration by the Minister, directing that the applicant met the criteria for a Subclass 820 (Partner) visa concerning clauses 820.211(2) and 820.221(1)(a) of Schedule 2 to the Regulations. This indicated that while the marriage was valid, further assessment was required regarding the other elements of a genuine and continuing spouse relationship.
