CaseChat Overview and Summary

The Administrative Appeals Tribunal considered an application for a Visitor (Class FA) visa, Subclass 600, by a 58-year-old widow residing in Vietnam. The review applicant, her son who is an Australian citizen, sought to have her visit him and his family in Australia. The Tribunal was required to determine whether the visa applicant met the criteria under clause 600.211, which mandates satisfaction that the applicant genuinely intends to stay temporarily in Australia for the visa's purpose, considering past compliance with visa conditions, intended future compliance, and any other relevant matters.

The Tribunal's assessment focused on the applicant's migration history and her stated intentions. Evidence revealed that the applicant had previously overstayed a Visitor visa by approximately five to six years. Furthermore, the review applicant initially stated his mother did not intend to migrate permanently, but later indicated she desired permanent residence to spend time with her grandchildren, despite applying for a Contributory Parent visa (Subclass 173), which can lead to permanent residency. The review applicant offered financial support and a promise of compliance with visa conditions to mitigate concerns arising from the previous overstay.

On balance, the Tribunal was not satisfied that the visa applicant genuinely intended to stay temporarily in Australia. The significant previous overstay, coupled with the conflicting statements regarding her intentions about permanent residency and the application for a visa pathway to permanent residence, led the Tribunal to conclude that the requirements of clause 600.211 were not met. Consequently, the Tribunal affirmed the decision not to grant the Visitor visa.
