Nguyen (Migration)

The Administrative Appeals Tribunal considered an application for a Visitor (Class FA) visa, Subclass 600 (Tourist stream), made by Ms. Nguyen Thi Hue. The dispute centred on whether Ms. Nguyen genuinely intended to stay temporarily in Australia for the purpose for which the visa was sought, as required by clause 600.211 of the Migration Regulations. The Tribunal was tasked with determining if Ms. Nguyen met this criterion, having regard to her compliance with previous visa conditions, her intention to comply with future visa conditions, and any other relevant matters.

The Tribunal was required to assess whether Ms. Nguyen genuinely intended to visit her sister's family in Australia temporarily. This involved considering her past compliance with visa conditions, specifically whether she had substantially complied with the conditions of her last substantive visa or any subsequent bridging visa. The Tribunal also had to evaluate her stated intention to comply with the conditions of the Subclass 600 visa and consider any other factors that might indicate her true intentions regarding her stay in Australia.

In its reasoning, the Tribunal noted Ms. Nguyen's history of substantial compliance with previous visitor visas, having visited Australia three times since 2012 and returning to Vietnam on each occasion. The Tribunal also considered evidence presented by Ms. Nguyen's sister, including the existence of a bridal and makeup business in Vietnam, a bank balance of approximately USD 55,000, and an offer to provide a security bond. However, despite these factors, the Tribunal was not satisfied that Ms. Nguyen genuinely intended to stay temporarily in Australia. The Tribunal found that the requirements of clause 600.211 were not met.

Consequently, the Tribunal affirmed the decision not to grant Ms. Nguyen a Visitor (Class FA) visa.
