The Administrative Appeals Tribunal considered an application for a Visitor (Class FA) visa, subclass 600 (Tourist stream), made by an applicant who had remained in Australia for a continuous period exceeding 12 months. The core dispute revolved around whether the applicant genuinely intended to stay temporarily in Australia for the purpose for which the visa was sought.

The Tribunal was required to determine if the applicant met the criteria under regulation 600.211 of the Migration Regulations 1994. This involved assessing whether the applicant genuinely intended to stay temporarily, considering their compliance with previous visa conditions, their intention to comply with the conditions of the Subclass 600 visa, and any other relevant matters. Specifically, the Tribunal had to evaluate the applicant's stated intention to visit family and engage in tourist activities, against the fact that their proposed stay would exceed 12 consecutive months without exceptional circumstances being demonstrated.

The Tribunal's reasoning focused on the applicant's extended stay in Australia, which commenced in January 2020. Despite the applicant's assertions of being a genuine tourist with ties to Singapore, including a husband and a home, and providing evidence of financial capacity and planned tourist activities, the Tribunal found that exceptional circumstances for an extended stay were not sufficiently demonstrated. The Tribunal noted that the applicant had applied for a further 12-month visa, which would result in a total continuous stay exceeding 12 months. While acknowledging no breaches of previous visa conditions, the Tribunal ultimately concluded that the applicant had not satisfied the requirements of regulation 600.215, which relates to the genuineness of the applicant's intention to stay temporarily.

Consequently, the Tribunal affirmed the delegate's decision not to grant the Visitor (Class FA) visa.
