The Court concluded that the claims were not of a nature that would require them to be assigned to the Common Law Division of the Supreme Court under section 44 of the *District Court Act 1973* (NSW), and therefore the District Court did not have jurisdiction to hear them. Consequently, the appeal was allowed, the order of the District Court was set aside, and the matter was remitted for determination by the District Court.
