The court determined that there was a real likelihood of consumers being confused or deceived into believing that the goods sold under the 'REISS' mark originated from, or were connected with, Network, given the similarity of the marks and the identical nature of the goods in question.

Consequently, the court found that Reiss had infringed Network's registered trade mark. Network was granted an injunction restraining Reiss from using the 'REISS' trade mark in Australia in relation to clothing and apparel.
