CaseChat Overview and Summary
The key legal issues before the Commission were whether the agreement was genuinely bargained, met the "better off overall test" and adhered to the procedural fairness requirements. The Commission had to determine if the agreement provided for employees' rights and protections in a manner consistent with the objectives of the Act. Additionally, it needed to ensure that the agreement had been negotiated in good faith and that the parties had taken all reasonably practicable steps to reach an agreement.
The Commission found that the agreement was genuinely negotiated and met the requirements of the Act. It determined that the agreement provided for a fair and reasonable outcome for the employees, as it included provisions that were better off overall for the majority of the workforce. The Commission also concluded that the agreement was procedurally fair and that all reasonably practicable steps had been taken to reach the agreement. Based on these findings, the Commission approved the Nepean Power Workshop Enterprise Agreement 2013, noting that it would be effective from the date of the decision.
