However, the defendants refused to produce the witness proofs for inspection, claiming that they were subject to legal professional privilege. The plaintiff applied for an order that the proofs be produced for inspection. Olsson J examined the issue of whether the defendants' production of the Schaeffer report constituted a waiver of privilege over the witness proofs. The judge considered the principles established in Attorney-General for the Northern Territory v Maurice and Ors (1986) 161 CLR 475, which held that a waiver of privilege should be imputed or inferred when it would be unfair or misleading to allow a party to refer to or use privileged material without also disclosing the source material. However, Olsson J distinguished this case from the principles in Maurice as the production of the Schaeffer report was compelled by Supreme Court Rules R38.01, which required mandatory production of expert reports. The judge held that no voluntary waiver of privilege had occurred, as the defendants were compelled to produce the report by the rules and not by their own volition. Therefore, the essential precondition for any consequential imputed or inferred waiver of the source material was never satisfied. Olsson J declined to order the production of the witness proofs for inspection.
