Neate & Malin

In the matter of SYC 5038 of 2015, Ms Malin (the applicant) brought a contravention application against Ms Neate (the respondent) before Rees J of the Family Court of Australia. The nature of the dispute concerned allegations of contravention of court orders, as indicated by the applicant's filing of an "Application – Contravention". The respondent subsequently filed a "Response" to this application.

The central legal issue before the court was whether the applicant had established the alleged contravention of court orders by the respondent. This required the court to consider the evidence presented in relation to the contravention application and the respondent's response.

Rees J determined that the applicant had not satisfied the onus of proof required to establish the contravention. Consequently, the court dismissed the Application – Contravention filed by the mother. Furthermore, the court also dismissed the Response filed by the respondent.
