CaseChat Overview and Summary
The primary legal issue before the Commission was whether the proposed enterprise agreement met the statutory requirements set out in the Fair Work Act 2009. Specifically, the Commission needed to determine whether the agreement provided for fair and reasonable terms and conditions of employment, taking into account the relevant matters specified in the Act. The Commission also needed to consider whether the agreement complied with the procedural requirements and was made in good faith, without any element of coercion or undue influence.
After reviewing the evidence and submissions presented by both parties, the Fair Work Commission found that the proposed enterprise agreement was fair and reasonable. The Commission considered that the agreement provided for appropriate terms and conditions of employment, taking into account the needs of both the employer and the employees. The Commission was satisfied that the agreement had been made in good faith and without any element of coercion or undue influence. The Commission also found that the procedural requirements had been met, and that the agreement was in line with the relevant provisions of the Fair Work Act.
As a result of the Commission's findings, the proposed enterprise agreement was approved, and the Fair Work Commission issued an order approving the National Fleet Administrative Services P/L: and Transport Workers Union of NSW and NSW Company Drivers Enterprise Agreement 2017. The order, which was made on [date], confirmed that the agreement would govern the terms and conditions of employment for the union members, effective from the date of the order. The Commission's decision provides clarity and certainty for both the employer and the employees, ensuring that the agreement is fair, reasonable, and compliant with the relevant statutory requirements.
