CaseChat Overview and Summary

This case concerned an application for Australian citizenship by conferral made by Mr Nadiri. The Minister for Immigration, Citizenship and Multicultural Affairs refused the application, and Mr Nadiri sought review of that decision. The Administrative Appeals Tribunal (the Tribunal) was required to determine whether the Minister could be satisfied of Mr Nadiri's identity and whether he was of good character, as required by the *Australian Citizenship Act 2007* (Cth).

The Tribunal considered inconsistencies in Mr Nadiri's surname and date of birth. While acknowledging these discrepancies, the Tribunal found that the variations in his surname were explicable within his cultural context, where surnames are not always consistently used or may be adopted to comply with Western administrative requirements. Regarding his date of birth, the Tribunal noted that documentation from Afghanistan generally suggested a birth year around 1975, while his statement upon arrival in Australia indicated he was 30 years old, suggesting a birth year around 1980. Mr Nadiri testified that he did not know his exact date of birth due to the lack of birth records in his village.

Despite being satisfied as to Mr Nadiri's identity, the Tribunal was not satisfied that he was of good character. This conclusion was based on the provision of false personal information and bogus documents in previous visa and citizenship applications, particularly in relation to his son. The Tribunal found that these actions, even if not a deliberate attempt to deceive, involved a failure to ensure the documentation was not bogus. Consequently, the Tribunal affirmed the decision to refuse Mr Nadiri's application for citizenship.
