MZWHI v MIMIA [2005] HCATrans 925 [2005] HCATrans 925 14 NOVEMBER 2005

CaseChat Overview and Summary

The High Court of Australia considered an appeal by MZWHI against a decision of the Federal Court of Australia concerning the interpretation of the *Migration Act 1958* (Cth). The dispute centred on the validity of a decision made by the Minister for Immigration and Multicultural and Indigenous Affairs (MIMIA) to refuse to grant a protection visa to MZWHI. MZWHI, a citizen of Afghanistan, had arrived in Australia and sought asylum, claiming to fear persecution in his home country.

The primary legal issue before the High Court was whether the Minister's decision to refuse the protection visa was vitiated by a failure to afford MZWHI procedural fairness. Specifically, the court had to determine if MZWHI was entitled to be informed of, and given an opportunity to respond to, adverse information that the Minister proposed to rely upon in refusing his visa application. This involved an examination of the scope of the duty of procedural fairness in the context of administrative decision-making under the *Migration Act*.

Gummow and Kirby JJ held that the Minister's decision was invalid due to a breach of the duty to provide procedural fairness. Their Honours reasoned that where an administrative decision-maker proposes to make a decision adverse to an applicant, and that decision is based on information which is not already known to the applicant, the principles of natural justice require that the applicant be given notice of the adverse information and an opportunity to comment on it. In this instance, the Minister had relied on information concerning MZWHI's alleged past conduct which had not been disclosed to him, thereby denying him a fair hearing.

The High Court allowed the appeal, setting aside the decision of the Federal Court and remitting the matter to the Minister for reconsideration according to law.
