The Administrative Appeals Tribunal reviewed a decision concerning MYINSTALIKES.COM PTY. LTD. in relation to a nomination under the Direct Entry stream. The core dispute revolved around whether the nominated position and the nominator met the various requirements stipulated in regulation 5.19(4) of the Migration Regulations.

The Tribunal was tasked with determining if the applicant satisfied all the criteria for the approval of the nomination. Specifically, this involved assessing compliance with regulations concerning the application form and fee, the nominator's active and lawful operation of a business in Australia, the absence of adverse information concerning the nominator or associated persons, satisfactory compliance with workplace relations laws, and the nature of the nominated position, including the tasks to be performed, the genuine need for the position, and any associated training requirements.

In its reasoning, the Tribunal systematically addressed each relevant sub-regulation. It found that the application was compliant, the nominator was actively and lawfully operating a business in Australia, and there was no adverse information known to the Department. Furthermore, the Tribunal was satisfied that the nominator had a satisfactory record of compliance with workplace relations laws, supported by information from the Fair Work Ombudsman. Crucially, the Tribunal concluded that the tasks of the nominated position corresponded to those of a Business Analyst Management Consultant as specified in the Australian and New Zealand Standard Classification of Occupations (ANZSCO), and that the nominated position was based in regional Australia, fulfilling the requirements of regulation 5.19(4)(h).

Consequently, the Tribunal set aside the original decision under review and substituted a new decision approving the nomination.
