The primary legal issues before the Commission involved examining the fairness and compliance of the proposed enterprise agreement. This included verifying whether the agreement met the standard requirements for approval, such as not prejudicing the enforcement of awards, being free from coercion, and ensuring that it provided for the proper operation of the enterprise. The Commission also considered whether the agreement provided fair and reasonable terms for the employees, and whether it met the requirements for being a "better off overall" agreement.
The Fair Work Commission found that the MultiTek Solutions Pty Ltd Enterprise Agreement 2015-2018 was fair and compliant with the relevant legislation. The Commission noted that the agreement contained provisions that were in line with the Fair Work Act and did not disadvantage employees. It was also determined that the agreement was "better off overall" for the employees, as it provided for a fair and reasonable set of terms and conditions of employment. Consequently, the Commission approved the agreement, acknowledging its compliance with the necessary standards and its fairness to all parties involved.
In summary, the Fair Work Commission approved the MultiTek Solutions Pty Ltd Enterprise Agreement 2015-2018, finding it to be fair and compliant with the Fair Work Act. The Commission's decision was based on its determination that the agreement met the necessary requirements for approval and provided fair terms and conditions for the employees.
