CaseChat Overview and Summary
The Commission found that all the necessary conditions for approval were satisfied. The agreement was a genuine enterprise agreement, as evidenced by the fact that it had been negotiated in good faith and the bargaining representatives for the agreement, CEPU, had given notice under section 183 of the Act that they wanted the agreement to cover them. Furthermore, the agreement covered the organisation in accordance with section 201(2) of the Act. Consequently, the Commission approved the agreement, which will operate from 20 May 2016, and its nominal expiry date is 31 October 2019.
