Muijtjens (Migration)

The Administrative Appeals Tribunal considered the application of Ms Muijtjens for an Extended Eligibility (Temporary) (Class TK) visa, specifically a Subclass 445 (Dependent Child) visa. The core of the dispute concerned whether Ms Muijtjens met the eligibility criteria for this visa, which requires a specific relationship to a person holding a Partner visa.

The Tribunal was required to determine whether the applicant, Ms Muijtjens, satisfied the requirements of clause 445.211 of the Migration Regulations 1994. This clause mandates that the applicant must be a child of a person who holds a prescribed Partner visa. The Tribunal had to ascertain if the relationship between Ms Muijtjens and the Partner visa holder met this definition.

In its reasoning, the Tribunal found that Ms Muijtjens was the sister of the person holding the Partner visa, not her child. Consequently, the Tribunal was not satisfied that Ms Muijtjens met the definition of a child as required by clause 445.211. The Tribunal therefore affirmed the original decision to refuse the visa.
