CaseChat Overview and Summary
The primary legal issue the Fair Work Commission had to address was whether the agreement met the criteria set out in the Fair Work Act. Specifically, the Commission needed to determine if the agreement was made between an employer and employees, genuinely represented by a union, and not containing any terms that were prohibited or unenforceable. The Commission also considered whether the agreement was made in good faith and without duress.
After thorough consideration, the Fair Work Commission concluded that the proposed agreement did indeed meet the necessary criteria. The Commission found that the agreement was made between the employer and the employees, and that the union genuinely represented the employees. Additionally, the Commission was satisfied that the agreement was made in good faith and contained no terms that were prohibited or unenforceable. Consequently, the Commission approved the agreement.
The Fair Work Commission approved the MSS Security Pty Limited - United Voice - Perth Airport (WA) - Enterprise Agreement 2013. This decision effectively resolves the dispute between the applicants and respondents, confirming the agreement's validity and allowing it to be registered with the Fair Work Commission.
