Mouzakis and Mouzakis

In the matter of *Mouzakis and Mouzakis*, Young J of the Family Court of Australia was required to make orders concerning the conduct of proceedings between the husband and wife. The applications before the court included a contravention application by the husband, as well as other applications filed by the husband on Form 1 and Form 2.

The primary legal issue before the court was the scheduling of these various applications and ensuring the wife was properly notified of the adjourned hearing dates. The court also considered the implications of the wife's personal attendance at the contravention application hearing and the costs associated with the husband's appearance on that day.

Young J ordered that the husband's contravention application be heard on 24 August 2007, with a direction that the wife personally attend court at or before 10.00 a.m., failing which the application could proceed undefended, subject to proof of service. The husband's other applications were adjourned to 31 August 2007. The court further ordered that the husband's solicitors serve a sealed copy of the orders on the wife personally, along with clear advice regarding the adjournment dates. The wife was also ordered to pay the husband's costs of the appearance that day, fixed at $1,000.
