Mousa v Marsh

In *Mousa v Marsh*, the New South Wales Court of Appeal considered a dispute arising from a motor vehicle accident. The appellant, Mr Mousa, was driving his vehicle and attempted to turn right across oncoming traffic. At the same time, the respondent, Mr Marsh, was travelling in the opposite direction and passed stationary cars on his left. The vehicles collided. Mr Mousa brought proceedings against Mr Marsh, alleging negligence.

The primary legal issues before the Court of Appeal were whether the trial judge had erred in apportioning liability between the parties and, in particular, whether the discount applied to Mr Marsh's damages for contributory negligence was appropriate. The court found that the trial judge had correctly assessed the degree of negligence of each party and that the 20% discount applied to Mr Marsh's damages was appropriate, reflecting the balance of responsibility for the accident.

The appeal was dismissed, and Mr Mousa was ordered to pay Mr Marsh's costs.
