The court found that the trial judge had correctly assessed the degree of negligence of each party and that the 20% discount applied to Mr Marsh's damages was appropriate, reflecting the balance of responsibility for the accident.

The appeal was dismissed, and Mr Mousa was ordered to pay Mr Marsh's costs.
