Finally, if an overpayment was found, the court had to consider whether there were any special circumstances that would justify waiving the resulting debt to the Commonwealth.

In reaching its decision, the court found that Mr Mostovoy had benefited from pooling his resources with his former wife and was therefore to be treated as a member of a couple from his marriage until their separation on 2 July 2010, with no special reason to deviate from this. The court was satisfied that the deposits into Mr Mostovoy's casino account belonged to him and were to be considered income for the purposes of the Act. Crucially, the court found that the documentary evidence submitted by Mr Mostovoy to support his claims regarding the source of the funds, particularly a "Daily Analysis of Selected Patrons" report and a letter from the Casino, had been altered. The court accepted the Casino's versions of these documents, which showed significantly different figures and details, and concluded that Mr Mostovoy had not provided a satisfactory explanation for these discrepancies.

Consequently, the court found that Mr Mostovoy had received more in disability support pension than he was entitled to, resulting in a debt to the Commonwealth. The court was not satisfied that there were any reasons, including special circumstances, why Mr Mostovoy should not be required to repay the full amount of the overpayment.
