CaseChat Overview and Summary

In the Federal Court of Australia, the case of Morton and Waisak v Black was heard. The applicants sought to establish that certain representations made by the respondent were false, by showing that similar representations had been made to another purchaser under similar circumstances. The legal issue before the court was whether evidence of similar facts could be admitted to prove the alleged false representation. The court considered the decisions in Figgins v Centrepoint Freehold and Gates v City Mutual Life Insurance, but found that these cases involved representations made to multiple people rather than a single instance of similar conduct.

The court further examined the case of Royce v Cafred Pty Ltd, where a similar attempt to introduce evidence of similar facts was rejected. The court noted that even if such evidence were admissible, it should be excluded in the exercise of discretion as it could introduce collateral issues that do not contribute to determining the main issue. The court concluded that the evidence of one individual prospective purchaser could not establish a business practice and, therefore, did not assist the applicants. The judge rejected the application to admit similar facts evidence, finding that the considerations that led to excluding such evidence in other cases compelled the same view in this instance.
