CaseChat Overview and Summary
The Administrative Appeals Tribunal reviewed a decision concerning Ms Miriana Monroe's eligibility for social security payments. The dispute involved the application of a compensation preclusion period following a lump sum settlement of a workers' compensation claim. Ms Monroe sought review of a decision by the Social Services and Child Support Division (SSCSD) which affirmed the Respondent's decisions to cancel her Disability Support Pension (DSP) and reject her claim for Newstart Allowance (NSA), both on the basis of this preclusion period.
The Tribunal was required to determine whether the compensation preclusion period was correctly applied to Ms Monroe's DSP and NSA claims. Specifically, it needed to consider whether any special circumstances existed that would warrant setting aside the preclusion period for either payment. The Tribunal also had to address a procedural issue regarding the scope of the review concerning the DSP claim.
The Tribunal found that the evidence before it did not support the existence of special circumstances at the date of the DSP cancellation. Consequently, the decision to cancel the DSP was affirmed. However, regarding the NSA claim, the Tribunal considered that the compensation preclusion period should conclude earlier than initially determined. The Tribunal noted that a significant amount of evidence, including expert medical and occupational therapy reports, was available for the current review that had not been before previous decision-makers.
The Tribunal set aside the decision to refuse Ms Monroe's claim for NSA and remitted the matter to the Respondent for reconsideration. This reconsideration was to be conducted with the direction that, for the purpose of calculating the compensation preclusion period, a portion of the compensation paid to Ms Monroe be treated as if it had not been paid, thereby concluding the preclusion period on 21 September 2019. The decision to affirm the cancellation of the DSP was upheld.
