Mohammed (Migration)

The Administrative Appeals Tribunal considered the application of Mr Ahmed Pasha Mohammed for a Student (Temporary) (Class TU) visa, subclass 500. The applicant sought review of a decision by a ministerial delegate to refuse his visa application. The delegate had concluded that Mr Mohammed was not a genuine applicant for entry and stay as a student, nor did he genuinely intend to stay in Australia temporarily, raising concerns that he was using the student visa program to maintain ongoing residence in Australia.

The Tribunal conducted a fresh review of Mr Mohammed's application, taking into account the information provided by him, including his confirmation of enrolment, a questionnaire, and a statement addressing the genuine temporary entrant requirements. The Tribunal noted that the primary decision and the invitation to the hearing had clearly alerted the applicant to the issues concerning his genuine temporary entrant status and the relevance of Ministerial Direction number 69. The Tribunal's role was to assess whether, on the whole, the applicant met these requirements.
