[1] An application has been made for approval of an enterprise agreement known as the Moffat Pty Ltd Enterprise Agreement - NSW Service 2016 - 2019 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Moffat Pty Ltd. The Agreement is a single enterprise agreement.
[2] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

CaseChat Overview and Summary
The central legal issue in the case was whether the Fair Work Commission had correctly exercised its discretion in approving the enterprise agreement. Specifically, the court had to determine if the agreement met the statutory requirements under the Fair Work Act 2009, including whether it was made in good faith and whether it contained appropriate terms and conditions that were fair and reasonable. Additionally, the court had to assess whether the Commission adequately considered the impact of the agreement on the employees' rights and entitlements.
The Federal Court found that the Fair Work Commission had properly exercised its discretion in approving the enterprise agreement. The court held that the agreement was made in good faith and contained terms and conditions that were fair and reasonable. The Commission had appropriately considered the parties' submissions and the overall impact of the agreement on the employees. The court also determined that the Commission had not erred in its consideration of the agreement's compliance with the statutory requirements. Consequently, the appeal was dismissed, and the approval of the enterprise agreement was upheld.
The final orders of the court were to dismiss the appeal and affirm the decision of the Fair Work Commission approving the Moffat Pty Ltd Enterprise Agreement - NSW Service 2016 - 2019. The court's decision reinforced the importance of the Commission's role in facilitating fair and reasonable enterprise agreements, while also upholding the integrity of the statutory framework governing such agreements.
