CaseChat Overview and Summary

The Fair Work Commission (FWC) issued a statement on March 27, 2024, regarding the Modern Awards Review 2023-24, focusing on the topics of work and care. The Review aims to adjust modern awards to promote cooperative and productive workplace relations. The Australian Council of Trade Unions (ACTU) expressed a desire for a broader discussion on the topic of work and care, which led the Deputy President to revise the consultation schedule. The revised consultation schedule includes sessions on part-time employment, workplace flexibilities, working from home, rostering, hours of work, leave arrangements, personal/carers leave, and other variations to modern awards. These consultations will take place in Sydney and Melbourne from April 3 to April 11, 2024.

The court was required to decide on the appropriate topics for discussion during the consultations and how to effectively incorporate the feedback received from the submissions. The Deputy President had to balance the ACTU's request for a broader discussion with the need to maintain a structured consultation process. The legal issues involved ensuring that the consultation process was fair, transparent, and effective in achieving the objectives of the Review. The Deputy President needed to determine how to revise the timetable to accommodate the feedback received and ensure that the consultation sessions were productive.

The court's reasoning focused on the need to make effective use of the consultation dates while incorporating feedback from the submissions. The Deputy President decided to revise the schedule to include broader discussions on the topics of work and care. The court acknowledged the ACTU's suggestion for an open approach to the discussion and adjusted the timetable to reflect this. The Deputy President also published submission summaries to assist the parties in preparing for the consultations. The outcome was a revised timetable that included broader discussions on part-time employment, workplace flexibilities, working from home, rostering, hours of work, leave arrangements, personal/carers leave, and other variations to modern awards. The court ensured that the consultation process was transparent and that all parties had the opportunity to provide input.

The court ordered that the revised timetable for the work and care consultations be followed, with submissions in reply due by March 26, 2024. The consultations with interested parties will take place in Sydney on April 3 and 4, 2024, and in Melbourne on April 9 and 10, 2024. A tentative date of April 11, 2024, has been set aside for further consultations if needed. All correspondence and submissions on the work and care stream of the review should be emailed to awards@fwc.gov.au.
