Moammar and Secretary, Department of Social Services (Social services second review)

This matter concerned an appeal by Mr Moammar against a decision of the Secretary of the Department of Social Services affirming a decision that he was not eligible for a Disability Support Pension. The review was conducted by a Senior Member of the Administrative Appeals Tribunal.

The primary legal issues before the Tribunal were whether Mr Moammar's mental health conditions, specifically major depression and post-traumatic stress disorder, were fully diagnosed, treated, and stabilised, and whether these conditions resulted in an impairment rating of 20 points or more under the relevant Impairment Tables.
