The Administrative Appeals Tribunal considered an application for a Temporary Business Entry (Class UC) visa, Subclass 457, made by Sean Mitchell. The dispute concerned whether Mr Mitchell met the criteria for the visa, specifically in relation to an approved nomination. The decision was made by Member Katie Malyon.

The primary legal issue before the Tribunal was whether Mr Mitchell satisfied clause 457.223(4)(a) of Schedule 2 to the Migration Regulations 1994. This clause relates to the requirements for an approved nomination in support of a Subclass 457 visa application.

The Tribunal found that Mr Mitchell did meet the specified criteria. Consequently, the Tribunal remitted the application for reconsideration by the Department, with a direction that the first applicant, Mr Mitchell, meets the criteria under clause 457.223(4)(a). The application of the second applicant, Miss Megan Jay Kelly, who applied as a member of Mr Mitchell's family unit, will be determined by reference to the outcome of Mr Mitchell's application.
