Their Honours found that the delegate had adopted an overly narrow approach to the assessment of risk, failing to give adequate weight to the potential for harm based on SZGUR's ethnicity and perceived political affiliations. The Court reaffirmed the principle that administrative decision-makers must consider all relevant considerations and must not take into account irrelevant considerations when exercising their statutory powers. The appeal was dismissed.
