Minhaj v The Queen

This matter concerned an application for special leave to appeal to the High Court of Australia by Mr Minhaj against the decision of the Supreme Court of New South Wales. The dispute arose from Mr Minhaj's conviction for a number of offences, including aggravated break and enter and assault occasioning actual bodily harm. The application for special leave to appeal was heard in chambers by Callinan J.

The primary legal issue before Callinan J was whether the applicant had demonstrated an arguable case of error in the decision of the New South Wales Supreme Court, which had dismissed his appeal against his conviction and sentence. Specifically, the applicant sought to argue that the trial judge had erred in admitting certain evidence and in his directions to the jury.

Callinan J considered the grounds of appeal advanced by the applicant. His Honour found that the applicant had failed to establish any substantial error in the judgment of the Supreme Court of New South Wales. The grounds of appeal were found to be without merit, and the applicant had not demonstrated that the case involved a question of law that ought to be reviewed by the High Court.

Special leave to appeal was therefore refused.
