CaseChat Overview and Summary
The primary legal issues before the court were whether the dismissal was genuine and whether the employer had followed the correct procedures. Zaballero claimed that Zodiac did not follow the required procedures and that the dismissal was not genuine. Zodiac, on the other hand, argued that the dismissal was justified and that the correct procedures were followed. The court needed to determine the validity of these claims and decide if the dismissal was unfair.
The court examined the evidence presented by both parties and considered the relevant provisions of the Fair Work Act. The court found that Zodiac had not followed the correct procedures in terminating Zaballero's employment. Additionally, the court concluded that the dismissal was not genuine and that Zaballero had been unfairly dismissed. Based on these findings, the court ordered that the dismissal be unfair and that Zaballero be reinstated to his former position with back pay.
