CaseChat Overview and Summary

In the Fair Work Commission, Metro Urban Management Pty Ltd, trading as Metro Urban Management Pty Ltd, sought approval of an enterprise agreement with the Transport Workers Union (VIC / TAS). The agreement, covering the period from 2023 to 2026, sought to regulate the terms and conditions of employment for employees working under the agreement. The Commission was tasked with determining whether the agreement met the necessary criteria for approval under the Fair Work Act 2009.

The central legal issues before the Commission were whether the agreement provided for fair and reasonable terms and conditions for the employees, and whether it complied with the procedural requirements for approval as set out in the Fair Work Act. Specifically, the Commission needed to ensure that the agreement did not undermine the safety and health of employees, and that it was not contrary to any provisions of the National Employment Standards or the applicable awards.

In its decision, the Commission found that the agreement was fair and reasonable, taking into account the submissions from both parties and the broader context of the industry. The Commission noted that the agreement included provisions for minimum wage rates, leave entitlements, and dispute resolution mechanisms that were consistent with industry standards and practices. Additionally, the Commission was satisfied that the agreement met all procedural requirements for approval, including proper notification and consultation with the relevant parties. The Commission approved the enterprise agreement, acknowledging the balanced approach taken by both the employer and the union in reaching the agreement.

The Fair Work Commission approved the Metro Urban Management Pty Ltd and TWU (VIC / TAS) Enterprise Agreement 2023 to 2026, effective from the date of the decision. The agreement was to be registered with the Fair Work Commission, and it would govern the employment terms and conditions for the employees during the specified period.
