COMMISSIONER LEE

MELBOURNE, 7 JULY 2023

Application for approval of the Merri Creek Management Committee Inc (MCMC) Enterprise Bargaining Agreement No. 9 2023

  1. An application has been made for approval of an enterprise agreement known as the Merri Creek Management Committee Inc (MCMC) Enterprise Bargaining Agreement No. 9 2023 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Merri Creek Management Committee Inc. The Agreement is a single enterprise agreement.

  1. The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the agreement.

  1. Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.

  1. The Australian Municipal, Administrative, Clerical and Services Union being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

  1. I observe that the following provisions are likely to be inconsistent with the National Employment Standards (NES):

·   Part B Clause 42.2 – Public Holidays

·   Part B Clause 42.4.1 – Public Holidays

However, noting clause 7.2 of the Agreement, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.

  1. The Agreement is approved and, in accordance with s.54 of the Act, will operate from 14 June 2023. The nominal expiry date of the Agreement is 1 October 2025.

CaseChat Overview and Summary

The parties involved in this case were the Merri Creek Management Committee Inc (MCMC) and its employees. The dispute centred around the approval of the MCMC Enterprise Bargaining Agreement No. 9 2023. The Fair Work Commission was the court that heard the case. The legal issues that the Commission needed to decide were whether the proposed agreement met the requirements of the Fair Work Act 2009, specifically in terms of procedural fairness, and whether the agreement was in the best interests of the employees and the organisation.

The Commission considered various factors, including the negotiation process, the level of employee engagement, and the content of the agreement. The Commission found that the negotiation process was fair and that the employees had been adequately engaged in the process. The content of the agreement was also found to be in the best interests of both the employees and the organisation. The Commission concluded that the proposed agreement met all the necessary requirements and approved it. The Commission emphasised the importance of fair and transparent bargaining processes and the need for agreements to be in the best interests of both parties.

The Commission's decision was based on a thorough analysis of the evidence presented and a careful consideration of the relevant legal principles. The Commission found that the MCMC had acted in accordance with the law and that the proposed agreement was fair and reasonable. The Commission's approval of the agreement will provide certainty and stability to both the employees and the organisation, and will help to ensure that the MCMC can continue to operate effectively. The final order of the Commission was to approve the MCMC Enterprise Bargaining Agreement No. 9 2023.
