CaseChat Overview and Summary

This matter concerned orders made by Judicial Registrar Loughnan in proceedings between a husband and wife regarding the division of their property. The dispute centred on the ownership and transfer of two properties, identified as G and S, located in New South Wales, as well as a motor vehicle, a freight container, and superannuation interests.

The court was required to determine the terms of the property settlement, including the transfer of interests in the G and S properties, the discharge of a mortgage, and the allocation of liability for rates and taxes. Further issues included the consequences of non-compliance with the transfer orders, specifically the sale of the properties by public auction and the disbursement of sale proceeds. The court also needed to declare the sole ownership of other assets, including a Toyota Prado motor vehicle, a freight container, and superannuation, as well as all other assets in the possession or control of each party.

Judicial Registrar Loughnan ordered the husband to transfer his interest in the G property to the wife within two months, whereupon the wife was to discharge the St George Bank mortgage and assume sole liability for rates and taxes. If the wife failed to discharge the mortgage, the G property was to be sold by public auction with net proceeds disbursed to the wife. The husband was to transfer his interest in the S property to the wife upon her payment of $39,906.66, with the wife assuming sole liability for rates and taxes from that point. In default of this payment within two months, the S property was to be sold by public auction, with 70.5% of the net proceeds to the wife and the balance to the husband. The husband was declared the sole owner of his motor vehicle, freight container, superannuation, and other assets in his possession, while the wife was declared the sole owner of all assets in her possession. The Registrar of the Family Court of Australia was appointed to execute documents on behalf of the husband in the event of his non-compliance.
