CaseChat Overview and Summary

The applicant, Meatpak Australia Pty Ltd trading as Holco Fine Meat Suppliers, applied to the Fair Work Commission for approval of the Holco Darwin Enterprise Agreement 2016. The applicant sought to have the agreement made on 16 June 2016 approved under section 234 of the Fair Work Act 2009. The application was made on the basis that the agreement was a single, independent choice agreement. The applicants argued that the agreement had been made in good faith, and that it contained the minimum terms and conditions of employment that the parties had agreed upon. The Fair Work Commission was required to determine whether the agreement met the criteria for approval under the Fair Work Act. Specifically, the Commission had to consider whether the agreement was a genuine agreement made in good faith, whether it contained the minimum terms and conditions of employment agreed upon by the parties, and whether it complied with any other relevant requirements of the Act.

The Fair Work Commission found that the agreement met the criteria for approval. The Commission found that the agreement was a genuine agreement made in good faith, and that it contained the minimum terms and conditions of employment agreed upon by the parties. The Commission also found that the agreement complied with all relevant requirements of the Fair Work Act. In particular, the Commission found that the agreement was a single, independent choice agreement, and that it did not contain any terms that were contrary to public policy. The Commission approved the agreement under section 234 of the Fair Work Act, and the Holco Darwin Enterprise Agreement 2016 came into effect on 1 July 2016.

No further orders were sought or made by the Commission. The applicant's application for approval of the Holco Darwin Enterprise Agreement 2016 was successful, and the agreement was approved by the Fair Work Commission. The agreement now operates as a binding enterprise agreement under the Fair Work Act, and sets out the terms and conditions of employment for the relevant employees. The Commission's decision provides clarity and certainty for the parties, and ensures that the agreement is compliant with the requirements of the Act.
