Matic & Anor and Davies

In the matter of *Matic & Anor and Davies*, heard before Cronin J, the applicants sought and were granted leave to proceed on an undefended basis. The proceedings concerned the living arrangements and parental responsibility for a child, D, born in November 2007. The court was required to determine where the child D would live and who would hold parental responsibility for the child.

Furthermore, the court considered whether to grant the applicant, Ms Matic, leave to commence adoption proceedings for the child D, pursuant to section 60G of the *Family Law Act 1975* (Cth). The court also had to address the dismissal of all outstanding applications before it.

Cronin J ordered that the child D live with the applicants and that the applicants have sole parental responsibility for the child. Leave was granted to Ms Matic to commence adoption proceedings. The court also ordered that particulars of the obligations created by these orders, the consequences of contravention, and details of assistance for compliance be set out in an attached Fact Sheet, thereby incorporating these particulars into the orders. All outstanding applications were dismissed.
