Matech and Matech

In the Family Court of Australia, before Baumann J, orders were made concerning property and financial disclosure between a husband and wife. The dispute involved the exclusive use of a property, ongoing financial responsibilities for that property and a motor vehicle, and extensive disclosure requirements from the husband.

The court was required to determine the terms of interim orders regarding the matrimonial home, the husband's financial obligations for the property and a vehicle in the wife's possession, and the scope of financial disclosure to be provided by the husband. Additionally, the court considered the terms of an injunction to restrain the husband from dealing with certain assets and entities without providing prior notice to the wife, and a lump sum payment to be made by the husband to the wife.

Baumann J ordered that the wife have sole and exclusive use of the property at B Street, with the husband to be responsible for all costs associated with its ownership, including loan repayments, body corporate fees, insurance, rates, and water levies. The husband was also ordered to cover the insurance, registration, and maintenance costs for a motor vehicle in the wife's possession. An injunction was granted restraining the husband from dealing with B Street, or any entity or property in which he holds an interest, without providing the wife with sixty days' written notice, and imposing limits on transactions from his bank accounts. The husband was further ordered to disclose a comprehensive range of financial documents, including tax returns, financial statements, and bank statements for himself and any entities in which he holds an interest, as well as records relating to loans and property disposals to family members. A payment of $100,000 was ordered to be made by the husband to the wife by 27 April 2018, with the classification of this payment reserved. The wife's costs were reserved, and the proceedings were adjourned for a case management hearing.
