Marson and Marson (Child support)

The Administrative Appeals Tribunal considered an application by the father, Mr Marson, to extend a child support assessment beyond the child's eighteenth birthday. The mother, Ms Marson, sought to have the assessment continue on the basis that the child was undertaking full-time secondary education.

The Tribunal was required to determine whether the child was in full-time secondary education on their eighteenth birthday, which is a prerequisite for extending a child support assessment beyond that age under the *Child Support (Registration and Collection) Act 1988*.

The Tribunal found that the child was indeed enrolled in and attending full-time secondary education on their eighteenth birthday. Applying the relevant provisions of the Act, the Tribunal concluded that the criteria for extending the child support assessment were met. Consequently, the Tribunal set aside the previous decision under review and substituted it with its own decision.
